THIS CONTEST IS OPEN TO LEGAL RESIDENTS OF UNITED STATES and DC. VOID WHERE PROHIBITED. NO PURCHASE IS NECESSARY TO WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
OFFICIAL RULES
1. Eligibility: This Giveaway is open only to businesses and their business contact subscribed to the Proforma Ascension Marketing Group monthly newsletter at the time of drawing. If you accept the giveaway prize or item, you are agreeing to these terms. Must be 18 years of age or older as of the beginning date of this giveaway. The Giveaway is only open to legal residents of the United States, and is void where prohibited by law. Employees of the Proforma Ascension Marketing Group (shown as PAMG within these official rules), its affiliates, subsidiaries, (collectively the “Employees”), and their immediate family members and/or those living in the same household of Employees, Proforma corporate employees, and suppliers, are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.
2. Agreement to Rules: By participating and accepting the giveaway item (“You”) agree to be fully and unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, you agree to accept the decisions of PAMG as final and binding as it relates to the content of this Giveaway no matter what that determination is.
3. Giveaway Period: Giveaway period will be the dates listed on the previous giveaway page, beginning and ending at 12:00 pm est. All required actions to be eligible must be done by the expiration of the Giveaway Period.
4. How to Enter: Be a business or representative of said business, and a subscriber to the monthly PAMG newsletter at the time of drawing. By not being a subscriber at the time of drawing, you agree that you may be disqualified at the sole discretion of PAMG by not meeting this term, or any of the other terms found within this document. You may also be disqualified at the sole discretion of PAMG, if it feels you are attempting to fraud the system in any way, and agree that PAMG has the right to determine what it feels is fraud or cheating.
5. Prizes: The Winner of the Giveaway (the “Winner”) will receive (1) North Face Jacket with standard item logo customization at an approximate value of $145.00. Any additional requests are the responsibility of the winner. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by PAMG. No cash or other prize substitution shall be permitted. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of Winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for PAMG to use Winner’s business name, representatives name, likeness, actions or comments for purposes of any form of advertising and announcements, trade and to fulfill order of prize, without further compensation, unless prohibited by law. Winner agrees to pick up their item at PAMG offices and have their photo taken with the prize. Shipping will be permitted at the sole discretion of PAMG for those out of state from the PAMG offices. All items shipped will be the responsibility of the winner and not replaced in the event of theft or non-receipt for ANY reason.
6. Odds: The odds of winning depend on the number of newsletter subscribers.
7. Winner Selection and Notification: Winner will be selected by a random drawing under the supervision of the PAMG and all requirements verified. Winner will be notified by the business contact number or e-mail address on file, with five (5) days following selection of Winner. PAMG shall have no liability for Winner’s failure to receive notice due to inaccurate contact or e-mail information on file, technical or malfunction issues with the phone or devices, poor internet or cell phone services, failed delivery by any third parties, delay in checking their messages or e-mail before the 5 days ends, or any other reason. If Winner doesn’t reach back out to PAMG at the end-of-business on the 5th day, an alternate winner will be selected. Additionally, failure to claim prize within 5 days from the time said prize is ready for pick-up, the prize will be forfeited and given away at the discretion of PAMG. Receipt by Winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT PROFORMA ASCENSION MARKETING GROUP’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
8. Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that PAMG, anyone acting on behalf of PAMG, and PAMG’S successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your business name, business representatives name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. If the content of your acceptance of the giveaway is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Proforma Ascension Marketing Group from and against any suit, proceeding, claims, liability, loss, damage (whether to item received or during use) costs or expense, which PAMG may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right. You will be solely responsible for working directly with the manufacturer or supplier of prize once won if an issue arises for any reason, and it will not be the responsibility of PAMG to correct, pay for or replace the prize.
9. Terms & Conditions: PAMG reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond PAMG’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, PAMG may select the Winner from all eligible e-mails subscribers prior to and/or after (if appropriate) the action taken by the PAMG. PAMG reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Terms & Conditions. PAMG has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void subscribers for any reason, including, but not limited to: the use of bots, macros, scripts, or other technical means for entering. Any attempt by a subscriber to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws. Should such attempt be made, PAMG reserves the right to seek damages to the fullest extent permitted by law.
10. Limitation of Liability: By accepting the giveaway item, you agree to release and hold harmless Proforma Ascension Marketing Group and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, directors, as well as any suppliers or manufacturers of the giveaway item, from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such acceptance of the giveaway item and/or his/her acceptance, possession, manufacturer defects, accidents, injury, use, or misuse of any giveaway item or any portion thereof ; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the giveaway process or the promotion; (v) electronic or human error in the administration of the giveaway or the processing of subscriber methods required.
11. Disputes: THIS Giveaway IS GOVERNED BY THE LAWS OF BIBB COUNTY, GEORGIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, and solely and exclusively before a court located in Bibb County, Georgia specifically. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than business or business participant’s actual out-of-pocket expenses (i.e. costs associated with participating this Giveaway). Participant further waives all rights to have damages multiplied or increased.
12. Privacy: PAMG may collect information from and about you.
13. Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Proforma Ascension Marketing Group, 2240-2250 7th Street, Macon Georgia 31206., no later than 2 weeks after the dated giveaway closing window.
14. Sponsor: The Sponsor of the Giveaway is the Proforma Ascension Marketing Group, 2240-2250 7th Street, Macon Georgia, 31206.
15. By participating in this giveaway by any means, You, the business and business representative, agree that you have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
